1. Introduction

1.1 These terms and conditions ("Terms") apply to your use of our website (the "Website") and your purchase of products offered through it (the "Products").

1.2 Defined terms used in these Terms are set out in paragraph 26 (Definitions and Interpretation).

2. Acceptance

2.1 By using the Website or placing an Order, you confirm that:

(a) you are at least 18 years old; (b) you have the legal capacity to enter into a binding contract with us; and (c) you are not prevented by any applicable law from entering into a binding contract with us.

2.2 We reserve the right to request confirmation of your authority to accept these Terms.

2.3 We reserve the right to refuse you access to the Website where we reasonably consider this necessary, for example in cases of suspected fraud or misuse.

2.4 By placing an Order, you confirm that:

(a) you have read and understood these Terms in full; (b) your Order is an offer to purchase Products subject to these Terms; (c) any Order Confirmation we issue is based solely on these Terms; and (d) you agree to comply with these Terms.

2.5 If you do not agree to these Terms, you must not use the Website or purchase any Products.

2.6 By using the Website, purchasing Products, or agreeing to these Terms, you also agree to our Privacy Policy and our Acceptable Use Policy (see paragraph 12).

2.7 We recommend you keep a copy of these Terms for your records.

3. Personal Use

You confirm that you are purchasing Products for your own personal, non-commercial use, and not for resale or on behalf of another person or business.

4. Prices

4.1 The prices shown on the Website are inclusive of standard delivery charges within the United Kingdom.

4.2 Import duties and VAT are covered by us. Our Products are shipped from international fulfilment partners on a Delivered Duty Paid (DDP) basis, meaning Zurya is responsible for all applicable customs duties, import VAT, and clearance fees. You will not be asked to pay any additional charges upon delivery.

4.3 We take reasonable care to ensure prices, descriptions, and details of Products on the Website are correct. If we discover a pricing error, we will notify you as soon as possible and give you the option to reconfirm your Order at the correct price or cancel it. If we cannot reach you or do not receive a response, the Order will be treated as cancelled and you will receive a full refund.

4.4 We are not obliged to fulfil an Order at an incorrect price, even after an Order Confirmation has been sent, though we will always offer you the option described in 4.3.

4.5 Prices may change from time to time, but changes will not affect an Order for which an Order Confirmation has already been sent.

5. Placing an Order

5.1 All Orders are subject to stock availability. If we have sufficient stock, you will receive an Order Confirmation. If we are unable to fulfil your Order, we will notify you by email and refund any payment made.

5.2 A contract between us is only formed once we issue an Order Confirmation, and only in respect of the Product(s) listed in it. These Terms form part of that contract.

5.3 If your Order contains more than one Product, items may be delivered separately.

5.4 We may remove Products from the Website, or edit/remove content, at any time. We are not liable to you for doing so.

5.5 We reserve the right to refuse or cancel an Order at any time, including after an Order Confirmation has been sent. If we do so, you will receive a full refund of any amount already paid.

6. Payment

6.1 You can pay using any of the payment methods listed on the Website.

6.2 You may use a promotional voucher we make available to you, redeemable at checkout.

6.3 We use payment intermediaries (including PayPal and other processors) to handle payments. You agree that we may share necessary information, including personal data, with these providers for this purpose. See our Privacy Policy for details.

6.4 We are not a regulated payment institution. We are not responsible for payment failures caused by our payment providers, though we will assist you in resolving any issues where we reasonably can.

6.5 By placing an Order, you confirm that: (a) the payment method used is yours to use; (b) where applicable, you are entitled to use any promotional voucher applied; and (c) you have sufficient funds to complete the payment.

6.6 We are not responsible for unauthorised use of your payment card by third parties. We may report suspected fraudulent activity to the relevant authorities.

6.7 You agree not to make fraudulent chargebacks or reverse legitimate payments for Products you have received. This does not affect your statutory right to a refund where a Product is faulty, not as described, or where you have validly exercised your cancellation rights under these Terms.

7. Delivery

7.1 We will deliver your Order to the address provided at checkout.

7.2 We will provide an estimated delivery date at checkout.

7.3 If we cannot meet the estimated delivery date, we will notify you where reasonably possible. To the extent permitted by law, we are not liable for reasonable delays outside our control, though this does not affect your statutory rights if a delay is significant (see paragraph 9).

7.4 If we are unable to deliver to a particular location, we will notify you and either cancel and refund your Order or arrange delivery to an alternative address you confirm.

7.5 Risk in the Products passes to you on delivery.

7.6 If you are not available to accept delivery, the carrier will normally leave instructions for redelivery or collection.

7.7 If delivery fails due to your unreasonable refusal to accept it, or repeated failure to arrange collection, we may charge you reasonable costs incurred in returning the Order to us.

7.8 Orders are dispatched within 1–3 business days of confirmed payment. Standard delivery takes 3–8 working days from dispatch, as set out in our Shipping Policy. Products are shipped by our fulfilment partners once your full Order is ready.

7.9 As set out in paragraph 4.2, we cover all import duties and VAT — you will not be charged any additional customs costs on delivery.

8. Cancelling Your Order

8.1 Your statutory right to cancel. Under the UK Consumer Contracts Regulations 2013, you have the right to cancel your Order within 14 days, starting the day after you (or someone you nominate) receives the goods, without giving any reason. To cancel, email us at service@zuryafashion.com with your order number.

8.2 If you cancel before your Order has been dispatched, we will cancel it and refund you in full.

8.3 If your Order has already been dispatched when you cancel, please wait until you receive it and then return it to us in accordance with paragraph 10. We will refund you within 14 days of receiving the returned goods (or evidence that you have sent them back), including the standard delivery cost where applicable.

8.4 This cancellation right is in addition to, and does not limit, the extended 30-day returns window described in paragraph 10.

9. Faulty or Defective Products

9.1 We want you to be satisfied with your Product. Nothing in these Terms affects your statutory rights under the UK Consumer Rights Act 2015, which include the right for goods to be of satisfactory quality, fit for purpose, and as described.

9.2 If a Product you receive is faulty, damaged, or not as described, please email us at service@zuryafashion.com with your order number, a description of the fault, and photographic evidence.

9.3 Under the Consumer Rights Act 2015, if you report a fault within 30 days of delivery, you are entitled to choose a full refund (your short-term right to reject). After 30 days, you may be entitled to a repair, replacement, or partial refund, depending on the circumstances.

9.4 There is no charge to you for returning a faulty Product, and we will cover the cost of return shipping in these cases.

9.5 We will inspect returned Products and aim to resolve your claim as quickly as possible. We will keep you updated by email throughout this process.

9.6 Product images on the Website are for illustration and may differ slightly from the Product you receive; this does not itself constitute a fault.

10. Returns and Refunds (Change of Mind)

10.1 In addition to your statutory cancellation right (paragraph 8), we offer an extended goodwill returns window: if you are not completely satisfied with your Order, you may return it within 30 days of delivery.

10.2 To start a return, email us at service@zuryafashion.com with your order number and tracking information.

10.3 For change-of-mind returns (i.e. not faulty), you are responsible for the cost of return shipping.

10.4 The Product must be returned unused, in its original packaging, with labels intact. We reserve the right to decline a return that is not in a suitable condition, or to make a deduction from your refund reflecting any diminished value caused by unnecessary handling.

10.5 We will inspect the returned Product on arrival and notify you by email once your return is approved. Refunds are issued to your original payment method promptly after approval, and in any event within 14 days of us receiving the returned goods.

10.6 Because our Products are shipped internationally, transit times for returns may vary; we will keep you informed throughout the process.

11. Vouchers

11.1 Promotional vouchers or discount codes can be applied at checkout.

11.2 Only one voucher or discount may be redeemed per Order.

11.3 Voucher credit has no cash value and does not bear interest.

11.4 If a voucher does not cover the full Order value, the remaining balance can be paid using another available payment method.

11.5 If you return an Order paid for partly with a voucher, the voucher portion is generally reissued as store credit rather than a cash refund; any amount paid by another payment method will be refunded to that method.

12. Acceptable Use of the Website

12.1 You must not:

(a) do anything that damages or impairs the performance, availability, or accessibility of the Website; (b) use the Website unlawfully, fraudulently, or for any harmful purpose; (c) upload or transmit viruses, malware, or other harmful code via the Website; (d) scrape, harvest, or systematically extract data from the Website without our written consent; (e) access the Website using automated means (bots, scrapers) without authorisation; (f) violate our robots.txt directives; (g) use data collected from the Website for unsolicited marketing or to contact other users; (h) attempt to reverse engineer, decompile, or access the underlying code or structure of the Website; (i) use the Website to build a competing product or service; (j) resell, sub-license, or transfer your access to the Website to a third party; (k) attempt to gain unauthorised access to our systems, servers, or data; or (l) place fraudulent, speculative, or false Orders.

12.2 You are responsible for any loss we incur as a result of your breach of this paragraph 12.

12.3 Please notify us promptly at service@zuryafashion.com if you become aware of any misuse of the Website.

12.4 Information you provide to us must be accurate, lawful, and must not infringe the rights of any third party.

13. Links to the Website

13.1 Links from our Website to third-party sites are for information only and do not imply our endorsement.

13.2 We have no control over, and no responsibility for, third-party sites linked from our Website.

13.3 You may link to our homepage fairly and legally, provided this does not damage our reputation. You must not frame our Website or suggest an affiliation that does not exist without our written consent.

13.4 We may withdraw permission to link to our Website at any time.

14. Intellectual Property

14.1 We (or our licensors) own all intellectual property rights in the Website and its content, including Product descriptions and images.

14.2 You may use the Website and its content only for your own personal, non-commercial use.

14.3 Please notify us at service@zuryafashion.com if you suspect any infringement of our intellectual property rights.

14.4 You may not use our trade marks without our prior written consent.

15. Data Protection

15.1 Our Privacy Policy explains how we collect, use, and protect your personal data, and forms part of these Terms.

15.2 We use cookies on our Website, as described in our Privacy Policy and Cookie Policy.

16. Website Security

16.1 We do not guarantee that the Website will be secure or free from errors or viruses. You are responsible for using appropriate anti-virus protection.

16.2 You must not knowingly introduce viruses or other harmful material to the Website, or attempt to gain unauthorised access to it or the systems behind it.

16.3 Any breach of this paragraph 16 will result in your access to the Website being withdrawn, and may be reported to the relevant authorities.

17. Our Liability to You

17.1 Nothing in these Terms limits or excludes your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 (satisfactory quality, fitness for purpose, and Products as described), the Consumer Contracts Regulations 2013, or any other consumer protection law that cannot lawfully be limited or excluded.

17.2 Nothing in these Terms limits or excludes our liability for:

(a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot lawfully be limited or excluded under English law.

17.3 Subject to paragraphs 17.1 and 17.2, we are not liable to you for any indirect or consequential loss (such as loss of profits or business opportunity) that was not reasonably foreseeable to both parties at the time you placed your Order.

17.4 Subject to paragraphs 17.1 and 17.2, our total liability to you arising from your Order is limited to the greater of £1,000 or the price you paid for the relevant Product(s).

17.5 We are not liable for delays or failures in performing our obligations caused by circumstances outside our reasonable control (a "Force Majeure Event"), such as extreme weather, industrial action, or supplier failures — see paragraph 19.

17.6 Claims relating to these Terms should be brought within a reasonable time, and in any event within the time limits set by law.

18. Indemnity

18.1 You agree to reimburse us for any loss we reasonably incur as a direct result of: (a) your material breach of these Terms; (b) your fraudulent or negligent misuse of the Website; save that nothing in this paragraph requires you to indemnify us for losses caused by our own negligence or breach of these Terms, or affects your statutory rights.

19. Force Majeure

19.1 If a Force Majeure Event prevents us from fulfilling your Order for more than one week, we may cancel the affected Order and refund any amount you have already paid for it.

19.2 We will act reasonably and in good faith in managing the impact of any Force Majeure Event on your Order.

20. Changes to These Terms

20.1 We may update these Terms from time to time. We will notify you of any material changes that could affect Orders already placed. The Terms in force at the time you place an Order will apply to that Order.

20.2 If you do not agree to updated Terms, you should stop using the Website; this does not affect Orders already placed under the previous Terms.

21. Suspected Breach

21.1 If we reasonably believe you have breached these Terms, we may, as appropriate and proportionate to the breach: issue a warning, suspend or restrict your access to the Website, decline to process an Order, or take legal action.

21.2 We will act reasonably and proportionately in exercising these rights.

22. Termination and Suspension

22.1 You may stop using the Website at any time.

22.2 We may suspend or restrict access to the Website for operational or security reasons, and will give reasonable notice where possible, except where immediate action is necessary (e.g. suspected fraud or security risk).

22.3 We do not guarantee uninterrupted availability of the Website and may need to carry out maintenance from time to time.

23. Effect of Termination

23.1 Termination of these Terms does not affect rights or obligations that arose before termination, including your statutory rights, and paragraphs 17 (Liability) and 18 (Indemnity) continue to apply.

24. General

24.1 You may not transfer your rights under these Terms to another person without our consent.

24.2 The rights and remedies in these Terms are in addition to, not instead of, rights available by law.

24.3 We use third-party providers (including Shopify) to host and operate the Website.

24.4 If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply.

24.5 A delay or failure by either party to enforce a right under these Terms does not waive that right.

24.6 These Terms are for the benefit of you and us only; they do not confer rights on any third party under the Contracts (Rights of Third Parties) Act 1999.

25. Governing Law and Jurisdiction

25.1 These Terms, and any dispute arising from them or your use of the Website, are governed by the laws of England and Wales.

25.2 Any dispute may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of that part of the UK.

25.3 This does not affect any additional rights you may have to bring a claim in the courts of the country in which you are domiciled as a consumer.

26. Definitions and Interpretation

26.1 In these Terms:

"Order" means the order you place through the Website to purchase one or more Products.

"Order Confirmation" means the email we send confirming acceptance of your Order (see paragraph 4.3).

"Payment Intermediary" means any third-party payment processor we use (e.g. PayPal).

"Product" means an item offered for sale on the Website.

"Website" means the Zurya website through which Products are offered and sold.

26.2 References to "paragraphs" refer to paragraphs of these Terms.

26.3 Headings are for convenience only and do not affect interpretation.

26.4 Words in the singular include the plural and vice versa; references to any gender include all genders; references to persons include individuals, companies, and other entities.
